How We Prepare Every Case for Trial
Insurance companies keep track of which law firms settle cheaply and which ones are ready to try a case. Our preparation is what puts us in the second group. From the first week, we work to lock down the evidence that wins at trial, including crash reports, scene photos, vehicle data, electronic logging device records, maintenance files, surveillance footage and complete medical records.
We bring in the right experts early, from accident reconstructionists and medical specialists to life care planners and economists who can calculate what a serious injury will cost over a lifetime. We interview witnesses while their memories are fresh, identify every responsible party and insurance policy, and build the case around the story a jury will hear. When the other side sees that level of preparation, settlement offers tend to change. When they don’t, we’re ready for the courtroom.
Personal Attention and Strong Communication
At a time when you’re facing uncertainty, financial stress, and physical pain, you need a lawyer who will be there for you, not one who disappears after the first meeting. We make it a priority to be accessible to our clients, whether it’s answering your call, responding to your questions, or sitting down with you face-to-face to discuss what’s next. We believe that great results come not just from legal skill, but from truly understanding our clients and what matters most to them.
When you work with Whitfield Crosby & Flynn, you’ll have a direct line to your attorney. We take the time to explain your options, help you understand the process, and make sure you’re comfortable with every decision made. A multi-state firm with a small-town approach means you get the resources to take on large insurance companies and the personal attention of a lawyer who knows your name.
Serious Injury Cases We Handle
Our firm has the resources and experience to take on a wide variety of serious injury and wrongful death cases in every community we serve.
Truck Accidents
The interstates and highways running through our four regions carry some of the heaviest freight traffic in the Midwest and South, and when a fully loaded tractor-trailer hits a passenger vehicle, the results are often catastrophic. We investigate every angle, from driver fatigue and brake failures to trucking company negligence and improperly secured cargo, and we hold every responsible party accountable, including the carrier, the shipper and the maintenance provider.
Car Accidents and Motor Vehicle Crashes
From rear-end collisions to head-on crashes on rural two-lane roads, we represent people injured in all types of motor vehicle accidents. We also represent motorcyclists, pedestrians, cyclists, rideshare passengers, and victims of drunk and distracted drivers whose lives have been changed by someone else’s carelessness.
Medical Malpractice
When healthcare professionals fail to meet the standard of care, the consequences can be physically and emotionally devastating. We pursue justice for victims of surgical errors, misdiagnoses, birth injuries, medication mistakes, and other forms of medical negligence. These cases require extensive investigation and expert testimony, and each state has its own procedural rules that must be followed before a claim can move forward.
Nursing Home Negligence
Families place their trust in nursing homes to care for their loved ones. When that trust is broken through abuse or neglect, our attorneys take swift legal action to protect the vulnerable and hold facilities accountable for bedsores, falls, malnutrition, medication errors and other preventable harm.
Premises Liability
Property owners have a responsibility to keep their premises safe. We represent clients injured by slip and falls, unsafe buildings, inadequate security, dog bites, and other dangerous conditions on private and commercial property.
Workplace Injuries and Mining Accidents
We help workers pursue compensation for job-related injuries, whether through workers’ compensation or a third-party personal injury lawsuit against a contractor, equipment manufacturer or other responsible party. Our attorneys handle industrial, construction, railroad and mining accident cases, including those involving serious injury or permanent disability.
Catastrophic Injury and Wrongful Death
When injuries are life-changing, or when a life is lost, our firm steps up with the kind of legal support families need. We handle claims involving traumatic brain injuries, spinal cord injuries, burn injuries, amputations, and fatal accidents with compassion and determination. When a preventable tragedy takes a loved one, we fight to hold the responsible parties accountable and secure the financial stability surviving families need.
Complex Litigation and Other Serious Injury Claims
We’re equipped to take on difficult, document-heavy cases that other firms may shy away from. Whether it’s a multi-party accident, a multi-state claim, or a complicated product liability case, we have the trial experience to tackle the toughest challenges. Our attorneys also handle claims involving defective drugs and medical devices, aviation and boating accidents, elevator and escalator injuries, and bars or restaurants that overserve drunk drivers.
Personal Injury FAQs
What should I do immediately after an accident?
Your safety is the top priority. Call 911, get medical treatment, take photos of the scene, gather witness names and contact information, and avoid admitting fault. Before giving a recorded statement to any insurance company, contact Whitfield Crosby & Flynn so we can protect your rights from the beginning.
How long do I have to file a personal injury lawsuit?
It depends on the state where you were injured. In Illinois and Indiana, most personal injury claims must be filed within two years. In Tennessee, the deadline is generally one year. Kentucky allows one year for most personal injury claims, but most motor vehicle accident claims have two years from the date of the injury or the last no-fault payment. Shorter filing deadlines and notice requirements can apply to claims against government entities, so it’s important to speak with an attorney as soon as possible.
Can I still recover damages if I was partially at fault?
In most cases, yes, but the rules differ by state. Kentucky follows pure comparative fault, so you can recover even if you were mostly at fault, with your award reduced by your share. Illinois and Indiana allow recovery as long as you were not more than 50 percent at fault. Tennessee allows recovery only if you were less than 50 percent at fault. In every state, your compensation is reduced by your percentage of fault.
Do you handle cases in Benton, West Frankfort, Herrin and other Southern Illinois towns?
Yes. Our Marion office represents injured people throughout Southern Illinois, including Carbondale, Herrin, Carterville, Benton, West Frankfort, Murphysboro, Harrisburg and the surrounding rural communities. If you were hurt anywhere along the Route 13 corridor or in the region south of I-64, we can help.
Which office will handle my case?
You can call any of our offices. We’ll look at where the injury happened, which state’s laws apply, and where the case should be filed, then connect you with the attorneys handling cases in that area. You’ll get the same trial-ready preparation and personal attention no matter which office you call.
What if I was injured in a different state from where I live?
This happens often in our region, where people regularly cross state lines for work, shopping and medical care. A case is frequently filed in the state where the crash or injury happened, but the defendant’s home state may also be an option. Because our firm practices in Illinois, Kentucky, Tennessee and Indiana, we can evaluate where your claim stands the strongest.
Are medical malpractice cases handled differently in each state?
Yes. Each state has its own requirements before a malpractice case can proceed. Kentucky and Illinois generally require a certificate or affidavit supported by a qualified medical review of the claim. Tennessee requires written notice to the provider at least 60 days before filing and a certificate of good faith. Indiana requires most claims to be reviewed by a medical review panel before a lawsuit can go forward in court. Our attorneys handle these requirements so your claim is not lost on a technicality.
What types of compensation can I receive in a personal injury case?
You may be entitled to recover damages for medical bills, lost wages, reduced earning capacity, pain and suffering, future treatment costs, and more. In cases involving especially reckless conduct, punitive damages may also be available.
Will I need to go to court for my injury case?
Not always. Many personal injury cases settle through negotiation or mediation. But if a fair offer isn’t made, Whitfield Crosby & Flynn is fully prepared to take your case to trial and fight for the compensation you deserve.
Can I afford to hire a personal injury attorney?
Yes. We handle personal injury cases on a contingency fee basis, which means you pay nothing upfront and owe no attorney fee unless we recover compensation for you. We believe everyone deserves quality representation, regardless of their financial situation.
